The Sites and the Contents are intended solely for personal, non-commercial use. You may download or copy the Contents displayed on the Sites for your personal use only. No right, title or interest in any downloaded Content is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or exploit in any way any of the Contents or the Sites.
Our privacy policy is: we collect and save “only” limited customer information such as email addresses and physical addresses when customers’ access our websites, mobile applications, and any other of our online services.
Our products are available exclusively online through our Sites unless otherwise, distribution rights have been granted to induvial retailers throughout the country. These products may have limited quantities and are subject to return or exchange ONLY in accordance with this site’s applicable return policy.
We have made every effort to display as accurately as possible the colors of our products that appear at the Sites. We cannot guarantee that your computer monitor’s display of any color will be accurate. We reserve the right to process and ship items with similar colors to the products’ shown on our site in the event a supplier fails to send us the desired color our consumer(s) had requested or we have sold out of the advertised color shown in any pictures on our site.
We realize many of our customers are tax exempt under Canadian and United States federal law. Since our company operates from an established tax exempt community, taxes will not be applied to this site even if, some of our site promotions state tax included.
From time to time, our company may experience lack of inventory which may result in a backordered item. We will notify you of any processing delays. The company absolves ourselves from any liability resulting from a backordered item. Our company uses reliable shipping methods and will rectify any problems arising from shipping within reason and the company’s better judgement.
Donations can and often times, will be distributed to proper agencies and authorities applicable to the “cause”. We reserve the right to distribute any donation proceeds ourselves to any individual, group, club, charity, organization etc., and proceeds acquired from any donation event will be subject to administration, site and third-party online payment processing platforms including this host site and STRIPE.
Any donations we receive are saved and distributed quarterly or annually depending on the amount collected. If our donation fund exceeds$5,000 per month, funds will be then re-donated on a quarterly basis. If donations do not reach $5,000 in a given month, then donation funds will be disbursed within one year of collection. We have and are currently compiling a database of agencies whom work and assist all veterans nation-wide and in the U.S. to whom we will be donating funds collected from our donation fund. We will post every donation made on our website via print or video link. Cape Sky Apparel uses a third party platform to collect monies from online purchases, contests and donations. This third party provider maintains a company provider fee. Cape Sky Apparel also maintains a service fee policy that includes maintaining a small flat-rate service fee to pay for its internal and external services and platforms.
Customers enter any of our governed contests at their own risk and are not guaranteed to win any prize winning awards. All electronic images and communications sent to us become the property of this site and our parent company site.
All contests we govern are free to enter but a donation membership is required for sign-up before entry. All winners will be paid by e-transfer only but a certified cheque can be requested by the winner. Canadian winners will receive Canadian funds. U.S. customers will also receive funds in Canadian dollars. U.S. customers’ purchases’ from this site will also be in Canadian dollars. We do not store or save customers’ credit card information. We do not share any customer information to any other external site. We do withhold a small flat-rate base fee on all donations collected to pay for internal services, platforms and third-party payment providers.
We now reserve the right to communicate with you at any time via electronic messaging. All customer information will never be sold or given to any other company and will be held in strict confidentiality. In the event any customer has their financial information stolen or misused through a third-party affiliate can contact us. Our company will initiate investigation procedures and will and will only compensate the consumer if we feel Cape Sky Apparel.com is responsible.
You can return any item after 15 days of receiving for any reason for full refund, however, we no longer process exchanges through shipment companies. In the event you wish to exchange an item, simply re-order the desired item at the correct size and color and we will send you the correct item you originally requested at 25% off the original listed price plus a second item of your choosing from the same category of the original purchased item for half the price of the original listed price plus a promotional coupon for your next purchase from our store. Customers should consult our size chart and read carefully before purchasing.
Cape Sky Apparel absolves ourselves from any liability including injury or death resulting from events that may be attributed to the branding of any of our items.
